1. About VoiceBen

VoiceBen ("we", "us", "our") is a check-in monitoring and escalation notification platform operated at voiceben.com. The service allows account holders ("Subscribers") to monitor vulnerable individuals ("Members") through automated daily check-in reminders and multi-level emergency contact alerts. VoiceBen is a communication and scheduling tool and is not a medical device, emergency service, or substitute for professional care.

2. Eligibility

You must be at least 18 years of age to create a VoiceBen account. By registering, you confirm that you are 18 or older and that the information you provide is accurate and complete. VoiceBen is intended for use within the United States and internationally where local laws permit automated messaging.

3. Account Registration & Security

You are responsible for maintaining the confidentiality of your account password and for all activity that occurs under your account. You agree to:

  • Provide accurate and up-to-date registration information
  • Keep your password secure and not share it with others
  • Notify us immediately at support@voiceben.com if you suspect unauthorized access
  • Not use another person's account without permission
  • Verify your email address before using the service

4. Acceptable Use

You agree to use VoiceBen only for its intended purpose — monitoring the wellbeing of consenting individuals. You must not:

  • Add Members or contacts without their knowledge or consent
  • Use VoiceBen to harass, spam, or send unsolicited messages
  • Attempt to reverse-engineer, hack, or disrupt the platform
  • Use the service for any unlawful purpose
  • Provide false contact information or impersonate others
  • Exceed the usage limits of your subscription plan
  • Circumvent SMS opt-out requests from contacts or Members
  • Use automated scripts or bots to interact with the platform

5. SMS Messaging & Consent

5.1 Types of SMS Messages

VoiceBen sends the following categories of automated SMS messages via Twilio on behalf of account Subscribers:

  • Check-in prompts to monitored Members — recurring, scheduled messages containing a one-time confirmation link. Frequency is up to 6 messages per day based on the subscriber's configured schedule.
  • Safety alert notifications to emergency contacts — event-driven messages sent only when a Member fails to complete a check-in within the configured grace period. Typically 0–3 messages per missed check-in event.
  • Opt-in confirmation — a single SMS sent when a phone number is first added to the system.
5.2 Your Consent Obligations

By adding a Member or emergency contact with a phone number, you confirm that:

  • The individual has consented to receive automated SMS messages from VoiceBen
  • The phone number provided belongs to that individual
  • You have the legal right to authorize SMS communications on their behalf
  • You will honour any opt-out requests and remove numbers promptly when requested

You are solely responsible for obtaining and maintaining valid consent from all Members and contacts. VoiceBen is not liable for messages sent to numbers for which you did not obtain proper consent.

5.3 Opt-Out

All SMS recipients may opt out at any time by replying STOP to any message. A confirmation message will be sent and no further messages will be delivered to that number. Reply HELP for support information.

5.4 Not a Condition of Purchase

Consent to receive SMS messages is not a condition of purchasing any VoiceBen subscription plan or using any feature of the service. Subscribers may use VoiceBen with email-only notifications on plans that support it.

5.5 Message & Data Rates

Standard message and data rates may apply to SMS recipients depending on their mobile carrier and plan. VoiceBen does not charge recipients for incoming messages.

6. Subscription Plans & Billing

6.1 Plans

VoiceBen offers three subscription tiers — Bronze (Free), Silver ($19.99/mo), and Gold ($49.99/mo) — each with defined limits on members, check-ins, contacts, and features. Plan details are available on our pricing page.

6.2 Billing

Paid subscriptions are billed monthly through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis. All fees are in US dollars and are non-refundable unless otherwise required by law.

6.3 Plan Changes & Cancellation

You may upgrade, downgrade, or cancel your subscription at any time through the billing portal. Cancellations take effect at the end of the current billing period. Downgrading to Bronze automatically reduces your active member and contact limits; excess records are not deleted but will become inactive until limits are satisfied.

7. No Emergency Services

IMPORTANT: VoiceBen is NOT an emergency response service. Check-in alerts are delivered via email and SMS on a best-effort basis and may be delayed due to network conditions, carrier filtering, quiet-hour suppression, or service outages. Do not rely solely on VoiceBen as the only safety measure for individuals at risk. Always have independent emergency contact plans in place. If you believe someone is in immediate danger, call 911 or your local emergency services immediately.

8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. Scheduled maintenance, server outages, or third-party provider failures (Twilio, Mailtrap, Stripe) may temporarily affect the delivery of notifications. VoiceBen is not liable for missed check-ins or undelivered alerts caused by factors outside our reasonable control.

9. Intellectual Property

All content, design, code, branding, and materials on VoiceBen are the property of VoiceBen and are protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any part of the platform without our written permission. You retain ownership of any data you upload or create within your account.

10. Privacy

Your use of VoiceBen is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the service, you consent to the collection and use of data as described in the Privacy Policy.

11. Disclaimers

VoiceBen is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the service will be error-free, secure, or continuously available.

12. Limitation of Liability

To the fullest extent permitted by law, VoiceBen and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the service, including but not limited to missed check-in notifications, undelivered alerts, or data loss. Our total liability to you for any claim shall not exceed the amount you paid to VoiceBen in the twelve months preceding the claim.

13. Indemnification

You agree to indemnify, defend, and hold harmless VoiceBen and its affiliates from any claims, liabilities, damages, or expenses (including attorney's fees) arising from your use of the service, your violation of these Terms, your violation of any applicable law, or your unauthorized use of another person's data or phone number.

14. Account Termination

We reserve the right to suspend or terminate your account at any time if you violate these Terms, engage in fraudulent activity, or for any other reason at our discretion. You may close your account at any time by contacting support@voiceben.com. Upon termination, your data will be retained per our Privacy Policy before deletion.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising under these Terms shall be resolved through binding arbitration or in the courts of competent jurisdiction, and you consent to exclusive jurisdiction in such proceedings.

16. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated to registered subscribers by email at least 14 days before taking effect. Continued use of VoiceBen after the effective date constitutes your acceptance of the revised Terms. The latest version will always be available at voiceben.com/terms.php.
